00:00:09

can we request the deletion of this data at any time?

00:00:13

True,

00:00:14

with some nuances,

00:00:15

the right to erasure or right to be forgotten

00:00:18

does exist in the GDPR but it is not absolute.

00:00:22

You can request that your data be deleted if it is no longer necessary,

00:00:26

if you withdraw your consent,

00:00:28

or if it was collected illegally.

00:00:30

However,

00:00:31

some data must be retained due to legal obligations,

00:00:34

for example,

00:00:34

for payroll,

00:00:35

billing,

00:00:36

or security.

00:00:37

Clearly not everything can be deleted right away.

00:00:40

And if I leave a company,

00:00:42

must it delete all my information?

00:00:44

True,

00:00:45

but not everything.

00:00:46

A company must delete what no longer needs to be kept,

00:00:49

but it must keep certain data for a legal period.

00:00:52

Your pay slips for social and tax reasons,

00:00:55

and your contracts or HR files according to the period provided by the law.

00:01:00

This is what we call the principle of proportionality.

00:01:03

We only keep what is useful,

00:01:05

justified,

00:01:06

and secure.

00:01:07

So when we request a deletion,

00:01:09

is there no waiting period?

00:01:11

False.

00:01:12

The company must respond within a period of one month.

00:01:16

It reviews the request,

00:01:17

checks which data can be deleted,

00:01:19

and which must be kept.

00:01:21

If complete deletion is not possible,

00:01:24

it must explain why and inform the person of their other rights,

00:01:28

access,

00:01:28

rectification,

00:01:29

restriction of processing.

00:01:31

The GDPR isn't about erasing everything,

00:01:34

it's about handling data with transparency and balance.
